Capita Selecta, Mercantile Law, Intellectual Property (IP) and Competition Law (CML41B0) is a final year LLB elective. Intellectual property or intangible assets are creations of the mind, which include inventions, copyrights, trade marks, designs, patents, among others. The module will cover various categories of Intellectual Property Rights (IPR) and their intersection with other spheres of law, including competition law, information technology and Artificial intelligence. The constitutional aspects of IPR and traditional knowledge systems/ Indigenous knowledge systems will also be addressed. The module consists of three assessments (one test, an assignment and an examination). Upon completion of the module, students will be able to do the following:
- Have the necessary knowledge to provide broad advice relating to the basic problems that are encountered in the field of IP. Both common law, legislative frameworks, and cases will be discussed.
- Have the necessary knowledge to create suitable advice relating to the typical problems that are encountered in the field of competition law.
Identify and discuss the role of international and regional arenas and how those impact national IP legislative frameworks.
