The 聽Law of Delict module introduces students to the legal principles governing civil liability for harm in South African law. The course focuses on understanding when and how a person may be held legally responsible for causing damage or injury to another. It examines the foundational elements of delictual liability conduct, wrongfulness, fault, causation, and harm as developed through South African case law and legislation.
The module aims to develop students鈥� ability to identify and interpret the relevant rules and principles of the law of delict and to apply these principles to practical legal problems similar to those encountered in South African courts. Through problem-based learning and legal analysis, students are encouraged to strengthen their critical thinking, analytical reasoning, and legal writing skills.
In addition, the course highlights the interconnected nature of private and public law by demonstrating how the law of delict relates to other legal disciplines. Students will draw on foundational legal skills acquired in their first year, such as case analysis and legal interpretation, and will explore the relationship between delict and areas such as the law of contract, criminal law, law of evidence, human rights law, and the law of persons and family law. This integrated approach promotes a comprehensive and well-rounded legal education while encouraging students to appreciate the broader role of delict in promoting accountability, fairness, and justice in society.
