About Prof MM Botha
Professor Monray Marsellus Botha is a Full Professor in the Faculty of Law at the 东京热 (UJ). He previously served as Head of the Department of Mercantile Law 东京热 and currently holds a professorship within the Department of Public Law. Before rejoining UJ in January 2022, he served as Deputy Dean and Head of the Department of Mercantile Law at the University of Pretoria (UP). He also served as Head of the Department of Mercantile Law 东京热.
Professor Botha holds an extensive interdisciplinary academic background in both law and commerce. His qualifications include the degrees BLC (University of Pretoria), BCom (Hons) (University of Pretoria), LLB (University of Pretoria), LLM (University of Pretoria), MCom (Business Management) (东京热) and LLD (North-West University). In addition, he holds specialised postgraduate diplomas, including the AIPSA Diploma in Insolvency Law and Practice, a Diploma in Alternative Dispute Resolution (AFSA/University of Pretoria), and a Diploma in Corporate Law (东京热). He has also completed two executive leadership qualifications through the Gordon Institute of Business Science (GIBS).
His doctoral thesis, completed in 2015, is titled 鈥Employee Participation and Voice in Companies: A Legal Perspective.鈥 The study examined the relationship between labour law and corporate governance, particularly the role of employee participation and voice within corporate decision-making structures. These themes continue to inform his broader scholarly work.
Professor Botha is an NRF-rated researcher and has held a C2 rating from the National Research Foundation since 1 January 2018, with his re-rating confirmed effective 1 January 2024. He has more than two decades of experience in the tertiary academic environment and has worked at several South African universities, including the University of Pretoria and North-West University. His research focuses primarily on labour law, corporate law, corporate governance and corporate social responsibility, particularly where these fields intersect. A defining feature of his scholarship is the exploration of the relationship between labour law and corporate governance structures, and of how employee interests, stakeholder governance, and accountability mechanisms are incorporated into corporate decision-making processes. He has published widely in accredited national and international journals and scholarly books. His work has appeared in leading journals such as the ILJ, THRHR, PELJ, TSAR, SA Merc LJ 听and Obiter. His research addresses issues including collective labour relations, whistle-blowing, corporate governance, social and ethics committees, corporate social responsibility, consumer protection and regulatory accountability.
He has also contributed to international scholarly works on labour regulation, corporate governance and sustainability. He regularly presents research at national and international conferences on topics such as worker participation, sustainability governance, corporate social responsibility, whistle-blowing, and consumer and digital regulation. His recent research increasingly examines the impact of technological developments, digitalisation and artificial intelligence on labour law, corporate governance and consumer protection in the online environment.
He has taught a wide range of undergraduate and postgraduate modules, including labour law, commercial law, business law, company law, specific contracts, alternative dispute resolution, transnational business law, cyber law, e-commerce and tax law. Through both his teaching and research, Professor Botha continues to explore the evolving relationship between labour law, corporate governance and the regulation of economic activity in the context of technological transformation and the changing nature of work.
